Landlord-Tenant Law and Government Publications

Successful Landlords keep abreast of current laws, rules and regulations surrounding owning and managing their rental properties. This page can help you navigate through the mass of information out there and provides some useful links to specific information on government and related sites at the IRS, HUD, EPA, etc. Please email landlord@managerentalproperty.com to report any "broken", incorrect or outdated links! Also, if you think there are additional sites or publications that might be of use to visitors, please let us know!

IRS
  • Publication 527: Residential Rental Property (Including Rental of Vacation Homes)
  • Publication 544: Sales and Other Dispositions of Assets
(Author's note: Pub. 544 includes discussion of 1031 exchange rules)
  • Publication 946: How to Depreciate Property

EPA

HUD

Fair Housing

State Specific

New Jersey

  • DCA-Divison of Codes and Standards-Bureau of Homeowner Protection: This site, part of the Department of Community Afffairs, provides Forms, Bulletins and links to Laws that Landlords and Property Managers need to know to be effective and compliant in managing their properties.
  • Legal Services of New Jersey (LSNJ LAW) publishes the book, Tenant's Rights in New Jersey: If you are a NJ Landlord this is a great resource. It is written for Tenants, so you'll get to see how the legal system coaches tenants in landlord dispute matters. Although they charge for the book, useful excerpts are published online for free, as per the link I have provided. LSNJ "coordinates the statewide Legal Services system in New Jersey, providing free legal assistance to low-income people in civil matters. This includes disputes involving landlords and tenants." It would be well worth a NJ Landlords time to read though and make sure they know some of the common issues that tenants complain about and how to stay clear of them and on the right side of the law. One of the keys to effort-less property management is doing it RIGHT the first time!
